As part of that commitment, we are pleased to post our annual PHIPA and FIPPA statistical reports, which is overseen by the Office of the Information and Privacy Commissioner of Ontario (IPC).
On January 1, 2012, all Ontario hospitals came under the Freedom of Information and Protection of Privacy Act (FIPPA), providing everyone the right to file an access request to records held by hospitals including records of personal information. FIPPA also allows individuals to request a correction to personal information.
Health records and personal health information is governed by the Personal Health Information Protection Act (PHIPA). Under PHIPA individuals can make an access request to their health record, as well as, request a correction to their health record.
Hospitals have an obligation to complete and submit a year-end statistical report to the IPC for the completion statistics for freedom of information (FOI) requests made under FIPPA and requests for access to health record(s) made under PHIPA.
A FIPPA access request is to be completed within 30 days or less. However, under section 28 (Notice to Affected Persons) of the Act, the hospital has an obligation to inform a third party when an access request is made. As a result, the third party notification process can potentially take more than 60 days, delaying the FIPPA completion time.
As a point of clarification for the PHIPA stats, an expedited request is when a patient requests information before a certain date, or stipulates urgency to the request.
